SIGN*A*RAMA WRAPS BUS IN PINK FOR BREAST CANCER NETWORK

How do you raise awareness of a great fund raising event?

Well if it’s the Make Breast Cancer History Gala Evening, simply wrap a passenger bus in trademark pink signage.

Sign A Rama Dandenong was given this mammoth task in September by the Grenda bus company, a major sponsor of the Make Breast Cancer History Gala Evening held in Melbourne in October.

The passenger bus – it seats 57 – took a week to wrap in eye -catching pink signage designed pro bono by Davidson Branding.

The Pink Bus is adding colour to Melbourne’s streets and helping to raise greater awareness of the need for continued funds - and it doesn’t stop there. Grenda has gone the extra mile by creating custom-made pink seat covers generously donated by McConnell Seats Australia and their fabric supplier, Reatex’s. The Pink Bus is as pink on the inside as it is on the outside!

The Pink Bus was on the streets of Melbourne from September 29th and was to run through October only, but it’s received such great support from the public that Grenda now plan to keep the bus decked in pink until the end of the year.

All funds raised by the Make Breast Cancer History Gala Evening will be donated to the Breast Cancer Network Australia (BCNA) and the National Breast Cancer Foundation (NBCF).

Sign*A*Rama Dandenong is helping to make breast cancer history!

SPECIAL FEATURE: PART 2 OF FRANCHISE EXPERT ADVICE SERIES

Part 2 of a 3 part advice series from Wisewould Mahony Lawyers

Resale Price Maintenance Issues

Can my franchisor force me to sell products at, or below, my cost price?

My franchisor has been advertising my products at the same price as my cost price.  I am not making any profit by selling these products.  In fact, I’m losing money because I still have to pay freight and other add on costs and then pay royalties under the Franchise Agreement.  I must honour the advertised price but can my franchisor force me to continue doing this even if I am selling at a loss?

The law prohibits a franchisor from stipulating a minimum price, but not a maximum price at which the product must be sold.  This concept is called Resale Price Maintenance.

A Franchise Agreement may state the franchisee has the sole discretion in determining prices, except where the franchisor has stated a price in advertising material, in which case, the franchisee can not sell the product for more than the stated price in the advertisement.  This is lawful, and a failure to comply will amount to a breach of the Franchise Agreement by the franchisee.

However, where the franchisor is obtaining royalties from gross sales (probably at increased levels due to successful marketing campaign) at reduced prices, and the franchisee is making a continued loss on sales, it may arguably amount to unconscionable conduct under the Act.  Much depends on the circumstances, particularly how long this pricing structure is expected to be in place for.

NEW INDUSTRY BODY ANSWERS DEMAND FOR SUPPORT

A NUMBER of prominent pool and spa aftermarket retailers have banded together to create a new industry body - the Swimming Pool Retail Association Australia (SPRAA).

SPRAA’s inaugural President, Mr Peter Barr, said the body was established to meet the specific needs of pool and spa retailers and field service technicians including the increasing demand for more relevant and appropriate training in the pool and spa aftermarket retail sector.

“With an executive board made up of founding members from Swimart, PoolWerx, Clark Rubber, BioGuard Poolside and leading independent pool stores SPRAA is an organisation formed for the industry by the industry,” he said.

“Our ultimate goal is to provide greater support, ancillary services and representation for those in the retail and service sectors of our industry.

“We want to ensure that this sector receives the support it craves and establishing SPRAA was the best option to achieve this.

“Specifically SPRAA will provide support to our sector of the industry in key areas such as training and education, maintaining and improving professional standards and liaising with government bodies for the benefit of members and consumers.”

Mr Barr said SPRAA would also provide a number of value-add services to its members.

“The benefits offered to SPRAA members will include having access to affordable government-approved training programs; specific industry representation; greater networking opportunities; a professional code-of-conduct for the retail and service sector; and a body that looks out for their needs and interests.

“We also plan to provide members with optional business related services further down the track.

“We envisage SPRAA members will also experience increased consumer confidence that comes from being a part of a national industry body tailored to provide support for retailers and service technicians specifically.”

30% of new franchisees recruited online

Results from a Franchisor Expansion Study by 10 Thousand Feet into the Australian franchising industry reports the following:

  • Just 10 per cent of Australian franchisors reported negative growth in 2008

  • Despite this, the $40 million plus franchisors spend on marketing each year to attract new franchisees will be significantly cut in 2009

  • Newspaper ad revenues will be one of the areas to suffer most, with just 11 per cent of new franchise leads generated through this medium in 2008 – down from 18 per cent in 2007.

In contrast, online and word of mouth recruitment strategies are set to grow with 29 per cent of new franchisees were recruited via word of mouth in 2008, and 30 per cent of new franchisees recruited

via online avenues!
