LOCAL STUDENT JETS OFF TO PARIS THANKS TO MICHEL'S PATISSERIE

 

Staring at the sparkling lightshow on the Eifel Tower, Mt Tamborine student Molly Sullivan-Stevens will be spending New Years in Paris after winning Michel’s Patisserie’s New Years Eve in Paris competition valued at $55,000.

 

Hearing the good news just in time for her 19th birthday, Molly said it was the best present she could ever receive.

“I was in shock for three days, but then it slowly started dawning on me; I probably won’t truly believe it until I’m at the airport on the plane,” she said.

 

“There is a whole list of stuff I get to do when I’m in France. For example, there’s a pastry making course in Montmartre, which is really cool because I love cooking desserts. I really want to go to the Louvre to see the Mona Lisa, too.

 

“I also get to see a show at the Moulin Rouge! One of my theatre teachers said he knows some of the dancers at the Moulin Rouge, so I’ll have to look out for them.”

 

After much deliberation the keen pastry baker will share one week in the city of love with her boyfriend Garry Burke.

 

“It was so hard deciding who to take with me. Now my boyfriend and I just need to start learning French,” she said.

 

Molly entered the competition via SMS after watching an episode of The Great Outdoors.

 

Michel’s Patisserie Marketing Manager Pia Harrison said Michel’s Patisserie was thrilled Molly, a keen pastry cook, was awarded the grand prize.

 

“What luck that our grand prize winner also happens to love cooking delicious pastries – just like we do at Michel’s Patisserie! We’d like to say a big bon voyage to Molly. I am sure she will have the time of her life experiencing all that Paris has to offer,” Ms Harrison said.

 

There are more than 335 Michel’s Patisserie stores operating across Australia, employing about 3,100 staff and serving around 26 million cups of coffee and 9.5 million slices of cake each year. The Michel’s Patisserie franchise network is owned and managed by Retail Food Group (RFG).

Part 1:  Product and Supply Issues for Franchisors and Franchisees

Third Line Forcing and Full Line Forcing

 

“Must I buy products from my franchisor, even if I can source these products at a better price

from non approved suppliers?

 

A Franchise agreement may require the franchisee to purchase products exclusively from the franchisor or its approved suppliers.  The franchisor may be supplying a particular product which can not be sourced elsewhere, or they may be using their buying power and supplying products at a reduced cost.

Franchise agreements which require the franchisee to purchase stock from a particular third party may also breach the “third line forcing” provisions of the Trade Practices Act (“Act”).  A franchisor, is however, entitled to impose quality standards which must be met by other approved suppliers if requested by the franchisee.  Third line forcing is prohibited by the Act without regard to its effect on competition in the market place. 

Franchise Agreements are generally worded to avoid this issue and franchisors can seek ACCC approval to enable them to provide such a restriction.

Where a Franchise Agreement requires the franchisee topurchase product only from the franchisor, this does not amount to third line forcing as it is between the parties themselves.  This is ‘Full Line Forcing’ and is prohibited by the Act only if it ‘substantially lessens competition’.  In most industries, this is highly unlikely to be the case.

Example:

Big Bite Pty Ltd (a sandwich bar) agreement reads as follows:

  • To protect the reputation of Big Bite franchise, all raw ingredients purchased by the franchisee must be supplied by the franchisor.
  • The franchisee shall acquire all ingredients from the franchisor.

This type of conduct (exclusive dealing) will only breach the Act if it has the ‘purpose or effect or likely effect of substantially lessening competition’.

Whether this substantially lessens competition requires detailed analysis and independent advice should be sought.  The burden of proof rests on the franchisee alleging the conduct.   Those allegations are difficult to prove, even if it prevents a franchisee from purchasing product from other suppliers at a reduced cost as the ‘market’ may not suffer.

GRAND OPENING FOR POOLWERX

On Saturday, PoolWerx Franchisees Shane and Carol Gobbi celebrated the grand opening of their third retail hub, PoolWerx Sutherland. The Gobbi’s also own PoolWerx retail hubs in Menai and Bonney Bay.

The Hon Danna Vale MP and Member for Hughes was on hand for the opening and to talk to clients about the importance of pool safety.

The horrific result of this year’s Royal Life Saving Society (RLSSA) drowning report has prompted PoolWerx to call for increased support from local councils to help reach zero preventable backyard drownings. 

PoolWerx, Australia’s leading pool and spa care network, has also highlighted the need for increased parental awareness and greater emphasis on swimming and water safety education with 3 out of 10 pools they conduct health checks on having safety issues that need to be addressed within the pool area.

30% of new franchisees recruited online

Results from a Franchisor Expansion Study by 10 Thousand Feet into the Australian franchising industry reports the following: 

 

  • Just 10 per cent of Australian franchisors reported negative growth in 2008

  • Despite this, the $40 million plus franchisors spend on marketing each year to attract new franchisees will be significantly cut in 2009

  • Newspaper ad revenues will be one of the areas to suffer most, with just 11 per cent of new franchise leads generated through this medium in 2008 – down from 18 per cent in 2007.

In contrast, online and word of mouth recruitment strategies are set to grow with 29 per cent of new franchisees were recruited via word of mouth in 2008, and 30 per cent of new franchisees recruited

via online avenues!

ARA comments ...

Australian Retailers Association (ARA) said the 0.9 percent increase in retail trade turnover was another sign of slow and sporadic retail recovery which should discourage any premature increase in interest rates when the Reserve Bank meets next Tuesday.

Pizza gets the tick

 

Pizzacutters has achieved a Heart Foundation Tick.  This is the second Australian pizza chain to respond to the Heart Foundation’s challenge, with Crust Gourmet Pizza bars launching the first tick approved pizzas in early 2008.  A Tick approved pizza at Pizzacutters has on average two thirds less salt and one third less saturated fat than comparable pizzas sold by the top two chains.  Independent tests guarantee it.
