ITNESS FIRST PRICING CAUSES CONCERN AT THE ACCCDuring January and February 2010 Fitness First displayed posters at its clubs advertising its "Gold Coin to Join" promotion. The ACCC considered that these posters did not comply with the law as they failed to state a total single price. As part of the undertaking Fitness First has agreed to continue its FFit program for teenagers for six months until 30 November 2010 at an estimated cost of $225,000. FFit is a Fitness First initiative to address the obesity issue amongst school aged children. EVEN THOUGH THE TERMS OF TRADE ARE POSITIVE ... SMALL BUSINESS CAN STILL BE DOING IT TOUCH ...Peter Switzer, well known business commentator, has identified that small business is really not out of the woods yet. TASTI D-LITE ... IS IT COMING TO AUSTRALIA ...
Yet another American franchise is targeting Australia, with frozen yoghurt chain Tasti D-Lite sending out representatives to Sydney and Melbourne to examine the possibility of opening locations in major cities. The announcement comes after a slew of American retailors have targeted Australia, including clothing chain Gap which intends to open its first store August 26, in order to escape the sluggish American retail environment. Annette Ahern at the US Consulate General's office says the franchise is hoping to leverage its emphasis on being a healthy dessert alternative to crack into the Australian market, which already has its fair share of yoghurt and ice cream chains.
WHAT IS IT LIKE TO BE IN A FOOD BUSINESS ... THAT IS NOT FRANCHISED?In the Franchising world we hear about the importance of “the system”, the importance of “key processes”, the need for uniformity and the peace of mind and power that this gives to new franchisees. Well what is it like not to have this degree of comfort. Well, it a lot of plain hard work where you are all things and you do all things. There are 40,000 retail food businesses in Australia employing less than 20 people. The life is hard, the hours are long and you can make a go of it – if you follow some very precise set of guidelines. CHANGES TO THE FRANCHISING CODE SEE FRANCHISOR'S SEEKING APPROVALChanges to the Franchising Code of Conduct see Franchisors lodging requests with the ACCC to change their agreements with Franchisees. Over the last couple of months Franchisors have been seeking ACCC approval to require Franchisees to purchase nominated products, use nominated products and use nominated suppliers. While these changes for the most part are procedural to ensure that Franchisors are conforming to the new code, it could also be a shake up for those Franchisees that might have been under the impression that they have had a degree of freedom in choosing their suppliers.
2010 ‘YOUNG RETAILER OF THE YEAR'WINNER AWARDED
The National Retail Association ‘Young Retailer of the Year’ for 2010 has been awarded to Kaylee Albronda, a 21 year old Myer Management Trainee based in Melbourne. The Young Retailer Event, which is in its 37th year, provides a national platform to recognise and reward excellence amongst young retailers under the age of 25, and to promote retailing as a career for young people. It gives young retailers the chance to exhibit their retailing skills, and be recognised by their peers, the retail industry, and the general community for their innovation, career achievements and outstanding performance in their stores. Accepting the coveted award, Kaylee who is undertaking the 12 month Myer Graduate Development Program, said "Winning the 2010 NRA Young Retailer of the Year Award was both a fantastic learning experience and an honour to be recognised in an industry that I am passionate about. To be the National representative for young retailers is a privilege and I will endeavour to fulfil the role fully. I look forward to an exciting year ahead as I continue to grow and develop in the retail environment".

THE EXPERTS GIVE MICHEL'S COFFEE THE THUMBS UP The experts, David and Matthew Gee from Barista Basics Coffee Academy in Sydney and Fiona Mair from Choice Magazine home sampled coffees from each of the 10 coffee chains and concluded that the coffee at Michel’s Patisserie was the best.
Michel’s Patisserie, with a taste test of 80% topped the poll with the “good colour” of its crema, its “smooth” flavour, and the “pleasant” aftertaste, with “no detectable bitterness”. The panel scored other chains as low as 40%.

PODS BEGINS FRANCHISINGPODS (Portable On-demand Storage) begins franchising in the UK. Currently operating in 48 U.S. states, Canada and Australia through its company-owned and independent franchise network, PODS is set to start selling franchises to people who have at least $1m in net worth with a minimum of $300,000 in liquid assets. We contacted PODS Australia for a comment but as yet have not heard back from them concerning their plans for Australia. We will bring you an update in our next edition. VIC HEALTH SUPPORTS LEVY ON FAST FOOD ADVERTISINGVicHealth has (21 July) welcomed a bid to introduce a mandatory levy on alcohol and junk food advertising, in light of research that shows the overwhelming majority of Victorians want these industries to be accountable for the harm they cause. “A levy on junk food and alcohol advertising would shift the focus away from products that are harmful for health and put the spotlight on the promotion of healthier products,” VicHealth CEO, Todd Harper, said. “We know from VicHealth research that the majority of Victorians support a levy and want more stringent restrictions on alcohol advertising. This sends a strong message to our politicians that this issue is one that the public care about and one that needs further debate.” Click here for more about this story

RAY WHITE PROVIDES UNDERTAKING AFTER COMPLAINT
An attempt to end a franchise agreement has led to Ray White (Real Estate) Pty Ltd giving the Australian Competition and Consumer Commission a court-enforceable undertaking for likely breaches of the Franchising Code of Conduct. Nick Edwards operated a Ray White franchise out of Charleville, Queensland under a five-year agreement from December 2008. However in February 2010, Ray White announced that it was ending the agreement without giving any reasons. "The Franchising Code of Conduct sets out a procedure that a franchisor must follow before it terminates a franchise agreement. Ray White did not follow this procedure," Acting ACCC chairman, Michael Schaper, said. Click here for more about this story

Gillard Revises Company TaxSpeaking in Mackay on July 3, Julia Gillard the recently installed new Prime Minister, announced that a previous undertaking to reduce the company tax rate to 28% had been scrapped and replaced with a 29% company tax rate. The impact of this will be felt most strongly on those small to medium businesses that are emerging from their ‘break even’ phase into their profit making phase. She went on to say, “Well, I think for small business there are great benefits in this package. They will see the reduction in company tax early. They will experience the benefit of being able to get a new tax concession for the capital equipment that they need. You know, setting up a restaurant or running a restaurant and you need new furniture. If you've got a small business and you need new tools and equipment there will be special tax benefits for you. And as we talk about the superannuation changes, this is really important to working Australians. But we understood that businesses including small businesses would need time to adjust, so the changes are being phased in slowly over time to enable people to adjust.” |

Franchising Code Amendments
From 1st July the new amendments to the Franchising Code of Conduct are in effect. The ACCC has released a comprehensive outline of the changes, including increased disclosure by franchisors to assist franchisees to make informed decisions prior to entering into franchise agreements. Court finds Franchisor's Behaviour UnconscionableNational franchisor Seal-A-Fridge Pty Ltd had engaged in unconscionable conduct towards its franchisees and failed to comply with the Franchising Code of Conduct, the Federal Court, Brisbane found. Eagle Boys Aims HighEagle Boys Pizza plans to open an additional 46 stores across Australia. The Sydney Morning Herald reported this week that this expansion follows a massive advertising campaign begun in March of this year. According to the SMH, Eagle Boys Pizza managing director Todd Clayton said high levels of inquiries from potential franchisees and underrepresentation in major capital cities meant the company would continue to roll out a high number of new stores in the coming years. Could a shortage of skilled workers could dampen Australia’s economic expansion, a new survey asks.The Australian Industry (Ai) Group/Deloitte survey of more than 400 chief executives found 34.7 per cent of businesses believed there was at least a high risk that a skills shortages would have an adverse effect on operations this year. Refund Home Loans Admit False and Misleading Statements
The Federal Court has issued orders by consent declaring that Refund Home Loans Pty Ltd and its founder and managing director, Wayne Rodney Ormond, have contravened the Trade Practices Act 1974.
Refund Home Loans and Mr Ormond made misleading statements to franchisees that they had been given approval by the Australian Competition and Consumer Commission in relation to Refund Home Loans' treatment of franchisees.

Banjo's Bakery founder Mark Saxby has been found guilty of tax fraud.
A Hobart Supreme Court jury found Saxby guilty of two counts of defrauding the Commonwealth in that he cheated on two of his tax returns.
Sentencing will be determined at a later date. Prosecutors are insisting on a jail term.

Government must strike a balance with
Franchising Code reforms
Hall & Wilcox Partner and Head of Franchising & Distribution, Bruce McFarlane, is urging Government to ensure it strikes a balance in the requirements asked of franchisors as part of its reform to the Franchising Code of Conduct.
Announced by the Minister for Small Business, Dr Craig Emerson on 3 March 2010, the reform requests franchisors provide prospective franchisees with a plain English document emphasising the key costs, benefits and risks of the franchise system.
Mr McFarlane said that Government needs to be mindful of achieving a balance in requirements between franchisors and franchisees.
“Better information for franchisees should mean less disputes, and that’s a good thing for the franchising sector overall,” he said.
“However, this needs to be balanced by the amount of information that franchisors are required to provide, so it’s not too onerous a task.
“I am also not convinced that creating a plain English version is going to substantially shift the bar of understanding amongst franchisees.
“There is already a lot of information available and franchise agreements and mandatory disclosure documents set out the legal framework of the franchisor/franchisee relationship. “Franchisees need to take responsibility to understand the elements of the legal arrangements before entering into the contract, and obtain independent legal and financial advice on the matter.”
Mr McFarlane said, “No matter what reforms are put in place or initiatives undertaken, the law cannot protect business failure absolutely. Potential and existing franchisees need to be educated and this should be the role of Government together with relevant industry associations like the FCA.”
The industry awaits the Government’s preferred format of the plain English guide. Government does not intend to introduce further changes to franchising laws in the next three to five years, in order to allow time for case law to develop and the effectiveness of the changes to be evaluated.

FIfty Snapon franchisees got behind the recent Movember project to raise awareness and funds for Beyond Blue and the Prostate Cancer Foundation of Australia. In total, the network has raised over $30,000, with one franchisee (Shane Bruni) raising approximately $18,000 on his own. As a result of Shane's Movember efforts, one of his customers visited the doctor for a check-up and found that he has early stages of prostate cancer. The good news is that it can be treated as it is has been detected early. Great job Shane and the entire Snap On team!

Pizzacutters has achieved a Heart Foundation Tick. This is the second Australian pizza chain to respond to the Heart Foundation’s challenge, with Crust Gourmet Pizza bars launching the first tick approved pizzas in early 2008. Legislation to effect small business
The initial phase of the Rudd Government's Fair Work Act 2009 came into effect on July 1, replacing the former WorkChoice legislation and experts are warning that many businesses may face an increase in costs with the rollout.
Major changes include holidays, redundancy and working hours. The cost of paying staff on weekends and public holidays means that small businesses may feel the pinch.

Australia’s third largest pizza maker Eagle Boys Pizza has released controversial results from an independent study that proves once and for all that Australians prefer the taste of Eagle Boys’ pizzas over those of pizza multinationals Domino’s and Pizza Hut.

Australian franchise, Trios, has been enjoying some international press coverage, so we thought we would share a news story review plucked hot off the press in Houston, Texas:
“This is really a first for the U.S. and the first in Houston,” says Na Chan, general manager of Trios Downunder. “It is a franchise that was started by three brothers in Australia. It’s flavorful but healthy fast food made with laffé, an Australian flat bread which we make into wraps. We also serve salads and spuds. We source only local products and use only 100 percent fresh ingredients. The group behind this venture is planning 15 more in Houston. They also own the rights to the franchises in the U.S. and China.”

7-Eleven Japan has agreed to pay a percentage of its franchisees costs for expired food which needs to be thrown away. The company had banned the discounting of items close to their used-by date and the payment was agreed to after the FTC in Japan warned the company that it should not stop its store operators from offering discounts.

As the next step in its response to the report of the Parliamentary Joint Committee on Corporations and Financial Services inquiry into franchising, the Government has released an options paper inviting final comment from relevant parties and the broader community.
The purpose of the options paper is to seek written comment on the amendments to the Franchising Code of Conduct discussed in the Joint Committee’s report.
The options paper builds on the consultation process undertaken to date and seeks new or additional information to that already provided in submissions to the Joint Committee.
This options paper requests comment against a series of very specific questions which clarify and fine tune the feedback we have received to date.
The Government is particularly interested in any potential change to the code that may affect costs and risks faced by franchisors and franchisees.
In order to keep the consultation process moving forward, any parties wishing to provide comment on some or all of the questions contained in the options paper are requested to do so by no later than close of business on 10 July 2009.

New look catalogues drive sales HOME
Catalogues, the most traditional tool in the retail marketing mix, have been given a new lease of life by the national hardware retail group, Home Timber & Hardware, as it introduces changes guaranteed to drive business growth for its stores and the brand.
Consumer research conducted by Home Timber & Hardware reveals its catalogues work on various levels to add significant value to the brand and its member promotional activity.
“Our recent research revealed that our catalogues have the most impact when it comes to advertising our products and they stay in households longer than any other media, “said Andrew Senyard, Danks National Marketing Manager.
“We’ve even been told stories of parents who give their kids a catalogue and find they are entertained for hours; they really do engage and inspire customers of all ages and we have proof of that.”
Referred to fondly as ‘Dogalogues’ to link to the brand’s mascots, Rusty and Sandy, the catalogues are an integral part of the support provided to Home Timber & Hardware members, over 200 independently-owned timber and hardware stores nationwide. The content of the new look Dogalogue was driven strongly by a shift in Home Timber and Hardware’s target consumers and their attitudes. Continuously evolving, Home Timber & Hardware now has an appeal that spans beyond the traditional handyman to the everyday consumer, and it was essential the catalogue reflected this move.
“The previous product selections were focused strongly on hardware and tools, so we refreshed the content to include a broader range of lifestyle products, meeting our audience’s needs and continued focus on DIY,” said Senyard.
“We also incorporated design features, such as bright colour coding and pointers enabling customers to easily identify and select products, whether they’re looking for tools, gardening products or environmentally friendly solutions.”
With the Dogalogue identified as a key communication vehicle, the design needed to enable Home Timber and Hardware to talk to the consumer about new products and services with the ability to duplicate the offering strongly in store.
And this is all wrapped up in a fresh, contemporary design with bold, consistent branding incorporating ‘proper’ DIY and tool tips from Rusty and Sandy.
According to Senyard, the introduction of the revamped Dogalogue has been greeted with enthusiasm by both Home Timber & Hardware stores and suppliers, who will benefit from enhanced product positioning and imagery.
“At the end of the day, the aim of the catalogue is to engage the reader and keep them reading right through to the end, inspired by the ideas, products and images they see. As a result of the changes, we believe it provides greater value as a communication vehicle for our stores and the brand.”

New Eagle Boys store opens every 19 hours
Eagle Boys Pizza will open one new store every 19 hours during the last eight days of the financial year, capping off 12 months of strong store growth and sales.
Between 22 and 30 June 2009, Eagle Boys will open 10 new stores across the company’s Standard, Micro, Local and Express store models. The new stores are located in Queensland, New South Wales, and Western Australia.
It comes as Eagle Boys expects to overtake Pizza Hut as the nation’s second biggest pizza chain within the next 12 months. The company is on track to have 400 stores operating by 2011.

Job Security Concerns Causing Flight to Franchising
Mortgage Choice, Australia’s largest independently-owned mortgage broker, has discovered that close to half of all Australians planning on purchasing a franchise in the next three years have been motivated by the difficult economic climate.
Its third annual Potential Franchisee Survey also revealed a renewed desire for income potential above all other outcomes that can be achieved by running your own business.
Of the 680 respondents looking to move into franchising by June 2012 11% had been retrenched during the past 12 months and a surprisingly high 41% said the economic downturn had influenced their decision to buy a franchise.
The most prevalent responses as to why the downturn had influenced them were:
48% - It seems safer to run my own business than have my job in someone else’s hands
40% - I believe I will be better paid by myself as boss rather than someone else
30% - My job is looking very shaky thanks to the downturn
This year, potential for earnings had risen in importance. In order of preference, the top three reasons for wanting to be a business owner were:
54% - Income potential (48% last year)
46% - Job satisfaction: looking for stimulation, challenge and personal achievement (54%)
44% - Flexibility: ability to control your own time/movements/etc (50%)
In some good news for the unemployed, the vast majority of respondents (92%) will hire staff in the first year after commencing business operations. 30% will hire one to two employees, 41% will hire three to five, 16% will hire six to 10, 5% will hire somewhere between 11 to 50.
52% of respondents will buy a new franchise while 48% will buy an existing one, and only 50% of survey respondents plan to enter into a franchise with a spouse or romantic partner.
Overall, the most appealing aspects of being part of a franchise system were:
Established franchisor brand recognition
Established business model for franchisees to follow
Higher likelihood of success in comparison to operating a small business
Level of support provided by the franchisor
Supplier relationships already established
Working within a collaborative franchise network
Level of advertising that can be achieved
Level of media coverage that can be achieved

Donut King has exported its first shipment of roasted coffee to mainland China, as part of its growing presence in that country. Due to arrive in Shanghai in early July, the 288kgs of DK Royal Bean coffee blend will be used by the 4 Donut King stores in Shanghai. |
The DK Royal Bean coffee has been specifically developed at Retail Food Group’s dedicated coffee roasting facility in Sydney, called Caffe Coffee. It is used in all Donut King outlets and features a unique blend of international beans.
The first shipment will provide more than 23,000 shots of espresso, with more shipments expected to follow later this year. More than 20 Donut King outlets are expected to be open in China by 2014.

We welcome Jason Gerkhe from the Franchise Advisory Centre with his comments regarding the Minister's announcement:
"Ever since the inquiry recommendations were reported in December, there has been a lot of anticipation and speculation about the implications for the franchise sector. The Minister's announcement is some news for the stakeholders involved in the inquiry, although details of the nature and extent of the targetted consultation to be undertaken are yet to be revealed.
Whatever consultation will be done will occur in a short timeframe given the announcement that the Minister expects consultations to start in the next few weeks, and a final response will be tabled in late July.
I'm looking forward to seeing more details."

Australian food retailers Donut King and Brumby’s GO! will open new stores in the lucrative service station food retail market as part of its ongoing expansion strategy, owner Retail Food Group announced today.
ASX-listed Retail Food Group (RFG) is Australia’s leading retail food brand manager and franchisor, owning the Donut King, Brumby’s Bakeries, Michel’s Patisserie and bb’s cafe franchise systems.
The first outlet of RFG’s franchise systems to open in a service station was a Donut King at Allendale, Cessnock in late 2008.
RFG has confirmed two new outlet openings in New South Wales and potentially a further five in South Australia in the next 12 months.

Peak retail industry body the Australian Retailers Association (ARA) has bagged Planet Ark's plea for Australians to sign an online petition to ban plastic check out bags, calling it an overly simple solution to the complex issue of litter management.

Newspaper ad revenues will be one of the areas to suffer most, with just 11 per cent of new franchise leads generated through this medium in 2008 – down from 18 per cent in 2007.
In contrast, online and word of mouth recruitment strategies are set to grow with 29 per cent of new franchisees were recruited via word of mouth in 2008, and

Franchises are increasingly looking to expand their bottom line by incorporating other businesses within their own.
NightOwl Mackay (Victoria Street) recently expanded their successful convenience retail business by opening an Eagle Boys Express store to provide customers with quality pizza on the go.
The Express Store is an Eagle Boys initiative that can operate in a space as small as six square metres. It makes use of new technology allowing pizzas to be prepared in-store in a third of the time as traditional pizzas.

API's retail business, under the Priceline banner, "encountered a volatile and fluctuating market but was able to maintain very good like-for-like growth", managing director Stephen Roche told the Australian.
The 320 Priceline stores, which sell toiletries, and hair and beauty products, had strong comparable store revenue growth of 5.7 per cent, but margins were lower.
Despite the economic contraction, the brand added 16 new franchised stores in the first half.

Peak retail industry body the Australian Retailers Association (ARA) said the 2.2 percent growth in retail turnover for March was in line with predictions and showed signs of slow recovery as cashed-up consumers re-entered the market without guilt.
ARA Executive Director Richard Evans warned against an over-reaction to the March retail trade figures (NSW 1.2%, VIC 2.7%, QLD 3.2%, SA 2.4%, WA 2.2%, TAS 2.2% NT 4.2%, ACT -0.1%) that were a result of economic stimuli from late last year.

Information to help business and consumers to understand the 'Clarity in pricing' amendments to the Trade Practices Act 1974 has been issued by the Australian Competition and Consumer Commission.

After threatening legal action, Kristy Kreme Donuts has today backed down after Arnott’s, Australia’s largest biscuit supplier, took them to task over allegedly violating their Iced Vo-Vo trademark.

McCurry is still on the menu for one Malaysian business owner
In Malaysia, McDonald's Restaurants have failed in their lawsuit against a local restaurant called "McCurry". The owners of the curry house argued that their business name is short for Malaysian Chicken Curry, and their logo of a smiling and waving red chicken could not be mistaken for a McDonald's restaurant. The Court of Appeal agreed.

The answer, it seems, all depends upon where you live:
Western Australia - public holiday Monday 27 April
ACT - public holiday Monday 27 April
However, if you live anywhere else in the country, ANZAC day will be held on Saturday 25 April - with no public holiday.

Kleenmaid Collapse
With $73 million owing, including $27 million of deposits from 6,000 customers who may never receive the items they bought, Kleenmaid has called in administrators.
The company has 20 retail outlets in Queensland, NSW, Victoria, South Australia and Western Australia with a turnover of $90 million in the year to June 2008. Some franchise owners are "bordering on broke". (It is reported that the company was still offering franchises for sale in February.)
The first creditors' meeting is being held today in Brisbane.

$50,000 payout for fast food franchise
A fast-food franchise in Perth’s CBD has been forced to back-pay many of its teenage workers $50,000 following investigations by the Federal Workplace Ombudsman.
