The key changes include:
End-of-term Arrangements: exit payments, arrangements regarding unsold stock, right of renewal.
Dispute Resolution: meeting participation, confidentiality and care to brand
There are also changes surrounding common law of good faith, disclosure, contract variation, capital expendicure and the sale of business."

MOVERS AND SHAKERS |
Today we meet Faith Manning - National Sales and Marketing Manager for the Retail Food Group.

Name: Faith Manning
Job Title: National Sales and Leasing Coordination Manager Retail Food Group
Main accountabilities: Store development, recruitment and advertising for new opportunities Australia-wide and Internationally. Recruitment of franchisees Domestic and International, advertising and promotion of our brands to attract franchise interest, media and publicity liaison with third parties. Sale of company stores.
What you like most about the job: The opportunity to assist potential franchisees into their dream business, the diversity of our franchisee family and the supportive culture within Retail Food Group.
Biggest challenges: The GFC has had a negative effect upon planned shopping centre developments going forward – this has had the flow on effect of restraining our ability to open new stores in brand new blue chip centres thus limiting our recruitment scope, team this with the banks tightening up with their lending and you see my challenge, however things are on the up and up and 2010 – 2011 is going to be a far improvement.
What you do to relax after work: Yoga and Pilates at the gym and the time to sit by my fire at home with good friends - a glass of red wine and some triple cream Jindi brie.
What you are currently reading/watching on the telly? Currently reading Eat - Pray - Love by Elizabeth Gilbert – WOW what a great read..... a true story of a 30 something woman seeking to find the meaning in her life travelling the world by experiencing the art of pleasure in Italy, the art of devotion in India and, in Indonesia, the art of balancing the two. What a plan hey!
TV – Masterchef – in my previous life I was a chef / restaurant owner - as was my husband. I still have a passion and a great interest in the industry and my son is an apprentice chef as well.
Thanks Faith – what a big job – and what an exciting company.

SNOOZE - IS NOT SO SNOOZY ... |
SNOOZE has been undergoing a great deal of change over the past few months.
The company has recently announced plans to increase its franchise network by 25% over the next 3 years, growing to 100 stores (it currently owns 72).
Snooze has taken on two new people to support this aggressive growth strategy: Marketing and Brand Manager, Sarah Baxter, and of Franchise Network Development Manager - Alistair Browne.
Snooze was recently listed in the top 10 Australian franchises in a survey voted for by more than 2,000 franchise owners. This survey delved into franchisee’s satisafaction in their current franchise – specifically focusing on franchise renewal, recommendation, lifestyle and business support. Snooze was the only bedding or furniture franchise business to be voted into the top 10.
Snooze has seen a 72% increase in franchisees willingness to recommend the business over the past 12 months. They’ve also seen a marked increase in existing franchisees purchase additional Snooze stores, as well as store managers going on to buy into the franchise themselves.
In a further bid to differentiate itself from competitors, Snooze has recently signed up to the member discount scheme with motoring bodies including NRMA, RACQ, RACV and RAC, entitling card holders to 15 per cent off their Snooze purchases. |

VIC HEALTH SUPPORTS LEVY
ON FAST FOOD ADVERTISING
VicHealth has (21 July) welcomed a bid to introduce a mandatory levy on alcohol and junk food advertising, in light of research that shows the overwhelming majority of Victorians want these industries to be accountable for the harm they cause.
“A levy on junk food and alcohol advertising would shift the focus away from products that are harmful for health and put the spotlight on the promotion of healthier products,” VicHealth CEO, Todd Harper, said.
“We know from VicHealth research that the majority of Victorians support a levy and want more stringent restrictions on alcohol advertising. This sends a strong message to our politicians that this issue is one that the public care about and one that needs further debate.”

RAY WHITE PROVIDES UNDERTAKING AFTER COMPLAINT
An attempt to end a franchise agreement has led to Ray White (Real Estate) Pty Ltd giving the Australian Competition and Consumer Commission a court-enforceable undertaking for likely breaches of the Franchising Code of Conduct.
Nick Edwards operated a Ray White franchise out of Charleville, Queensland under a five-year agreement from December 2008. However in February 2010, Ray White announced that it was ending the agreement without giving any reasons.
"The Franchising Code of Conduct sets out a procedure that a franchisor must follow before it terminates a franchise agreement. Ray White did not follow this procedure," Acting ACCC chairman, Michael Schaper, said.

INTERESTED IN CLIMATE CHANGE
AND THE COST TO BUSINESS?
This may help (but not much)!

The response was ….nothing…not as word…complete silence.

NAKED COWGIRL TURNS DOWN THE NAKED COWBOY ...
In the last edition of “The Insider” we reported that New York’s Naked cowboy had issued New York’s Naked Cowgirl with a cease and desist order from performing on the streets of New York unless she signed a franchise agreement.
In the latest move, the Cowgirl has stated that she has always been naked and that she would not agree to the Cowboys offer.

OLD SPICE ... AN ALMOST FORGOTTEN BRAND HAS BEEN REVIVED THROUGH SOCIAL MARKETING
... AT ALMOST NO COST
Last week we saw two days that shook the viral marketing world. Old Spice, a long-neglected Procter & Gamble brand unleashed a social media blitz that may have changed the rules of social network marketing.
At first glance, a franchisor may dismiss the Old Spice phenomenon as an oddity of riches, something only a marketing behemoth like P&G could exploit. But when we dissect its marketing principles and practices, it becomes not only entirely applicable to the small business owner, but an essential (and low-cost) opportunity as well.

HJ'S BOSS LEARNS
TO EAT HUMBLE PIE
Police arrested the former manager of Hungry Jacks Parklea for allegedly demanding cash payments of up to $3500 from Indian nationals who were hoping to get a job with the company.
Between May 2008 and February this year, the man arrested was employed as the manager of a Hungry Jacks restaurant at Parklea, in Sydney’s west. In his role he was responsible for the hiring and firing staff and it is alleged he used his position to extract cash from people desperate to get a job with fast food chain.
