BAKERS DELIGHT TAKES OUT FCA'S SOCIAL RESPONSIBILITY AWARD |

Bakers Delight has been awarded the ‘CFranchisor Social Responsibility Award’ at the Franchise Council of Australia MYOB Excellence in Franchising Awards, held at the 2009 FCA Gala Awards Dinner in Perth.
Chris Caldwell, General Manager of Marketing & Operational Support at Bakers Delight, said the network is continually developing and impleenting community, social and environmental initiatives. “Our commitment to local communities is pivotal to our connection with the Australian market. Having strong community links also reinforces that we aren’t a faceless brand – bakeries are run by real people from real communities. “Bakery employees get a lot of satisfaction from going back to the local communities they serve. There is a feeling of making a real difference to the lives of so many – it brings staff and the community together.” Bakers Delight has been a major corporate partner of Breast Cancer Network Australia (BCNA) for nine years, raising almost $3.7 million in this time. Through its bakery network, the company donates approximately $143 million of bread to charities each year. Other community engagement programs include the Top Sports grants program which saw Bakers Delight invest over $250,000 in 60 grassroots sporting clubs and 20 schools across Australia, and the Bundraiser campaign where bakeries donated $1 from every six pack of Hot Cross Buns sold to purchase valuable equipment for children’s hospitals around Australia. Bakers Delight also actively supports environmentally conscious practices through a range of initiatives and is currently rolling out new ‘Green’ artisan ovens, which will result in a 25 per cent reduction in energy resources. The network is also committed to the use of environmentally friendly calico bags and encourages paper bags where possible or the reusing of plastic bags, in an effort to reduce landfill. Bakers Delight was also the finalist for the FCA MYOB ‘Excellence in Marketing Award’ with its integrated recruitment campaign to attract 500 apprentices. Additionally, Bakers Delight franchisee Jo Patterson at Caneland QLD and former franchisees from Geraldton WA, Gerard and Carol Cafferkey, were finalists in the National ‘Franchisee Community Service Award’. Part 3 of a 3 part advice series from Wisewould Mahony LawyersExclusive Supply: Can my franchisor force me to sell products if I know there are no spare parts readily available?A franchisor may, under the Franchise Agreement, require a franchisee to acquire products exclusively from the franchisor. Where a franchisor can not supply spare parts, can a franchisee source spare parts from other sources without being in breach of the Agreement? Where there is a breach of a statutory warranty (for example, the product sold is not of merchantable quality, or fit for its purpose or requires spare parts) the retailer must provide a remedy to the consumer. The remedy may, in some cases, be a refund or, in other instances, it may be appropriate to repair the product. If there are no spare parts being offered by the franchisor, who has supplied the product, repair may be difficult, or impossible if the parts can not be sourced elsewhere. Fortunately for franchisees, the Act protects the consumer and also the franchisee as a retailer to a limited extent. It protects retailers by making the manufacturer of goods liable for manufacturing defects. A manufacturer must ensure spare partes are reasonably available for their products. The time frame considered ‘reasonable’ will vary depending on the industry and the particular product. The Act provides that a manufacturer who unreasonably fails to provide spare parts may be liable for damages for up to 10 years. There is an exception to this general proposition. If the manufacturer of the goods provides notice of their inability to provide spare parts, they will not be liable for damages. This may be significant where a franchisee is aware of the lack of spare parts, however, is pressured to sell the product by its franchisor. The Act prohibits a corporation from making misleading representations concerning the availability of spare parts. A franchisee should therefore advise the customer in the clearest terms that spare parts may not be available. It then becomes the customer’s choice whether to purchase the advertised product on that basis. If they do purchase on these terms, have the customer sign a written acknowledgement.
